Terms of Sale
By placing an order for wine, the Buyer warrants that they are at least 21 years of age, and that they will be responsible for the shipment of this wine being received by a person at least 21 years of age.
If wine is shipped to you, we contract with a 3rd party carrier who will ship wine that you have already purchased. Ownership of any Wine that PJ Wine Inc. sells changes hands at the time of purchase in the state of New York and is subject to sales tax in this state. By requesting that your wine be shipped to you, you are authorizing us to engage a common carrier to deliver your wine on your behalf. PJ Wine Inc. is not responsible for any breakage or damage of wine by said common carrier. WE MAKE NO REPRESENTATION TO THE LEGAL RIGHTS OF ANYONE TO SHIP OR IMPORT WINES INTO ANY STATES OUTSIDE OF NEW YORK. You, the buyer, are solely responsible for shipment of alcoholic beverage products and assume all obligations for compliance with your State's laws.
If PJ Wine Inc., for any reason, is unable to fulfill its obligations to the Buyer, PJ's sole obligation and the Buyer's sole recourse shall be a refund of the purchase price.
PJ Wine Inc. makes no warranty, expressed or implied, about the wine being sold except that PJ Wine Inc. is conveying clear title to the wine and, to PJ's knowledge, the wine is what its label describes it to be. Specifically, because wine by its nature is subject to change in the bottle over time, PJ Wine Inc. makes no warranty or guaranty of the quality or drinkability of any wine sold.
THE WARRANTIES SPECIFIED IN THIS CONTRACT ARE IN LIEU OF ANY AND ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
This contract is entered into in New York and shall be enforceable there under the laws of that State.
All goods are supplied form New York, NY and must be paid for in full prior to delivery. Thus, all goods are sold in New York and title passes to the Buyer in New York. All shipping costs, including insurance, are to be paid by the Buyer. New York sales tax is payable on all taxable goods delivered in New York.
Futures Wines, Temporary Storage,
Abandoned Orders, Return Policy & Shipping Seasons
We do not sell wines we don't own, plain and simple. Therefore, payment is due on futures wines at the time of purchase. We are collectors and wine enthusiasts ourselves – all of our wines are transported, and stored, in temperature-controlled spaces. That said, we will delay the shipment of any and all of our wines if we feel the temperature/season is unsafe. We'd rather that you receive your wine later, and perfect, than sooner and damaged.
While we guarantee the delivery of futures
wines, many of the factors in the delivery are beyond our control. We do the
best we can to estimate the expected arrival times of your wine, but we cannot
guarantee any specific arrival dates. Please keep in mind, delays can arise
unexpectedly and we are occasionally given inaccurate and/or incomplete
information by our shipping agent. If at any time you feel you need to cancel
your futures, you may do so.
We will refund you the original purchase price less a 10% cancellation fee.
We are happy to hold your wine, free of charge, from the date of your wine's arrival until the next shipping season. Please note, however, that we are not a wine storage facility. To keep our prices as competitive as possible, we rely on you to take responsibility for your wine as soon as possible. We have two key shipping seasons, in the spring (from roughly March until June) and in the fall (from roughly September until November) – see below for more details. If you do not take delivery of your wine in the first available shipping season after your wine arrives, we reserve the right to charge you monthly storage fees in the amount of $2 per case, per month. Because we store all orders separately, all orders under a case in size will be charged $2 a month
As an example, if you purchase an in-stock wine in August, you will be expected to take delivery of the wine during the immediate fall shipping season.

Abandoned Orders (Dead
You will be notified when your shipping season begins. If you do not respond to our notifications of your wine(s) arrival and/or fail to take delivery of your wine during your safe and appropriate shipping season (see above, "Temporary Storage," and below, "Weather & Shipping Seasons" for details) we reserve the right to charge you storage fees, as per above. After the first shipping season that your wine is in stock, or 3 months from the arrival of your wine (whichever comes first), and after at the very least two phone calls, you will be given a final email notice. You will have 30 days from the date of this final notice to get in touch with us to make plans for the delivery of your wine. If you fail to do so, we will return all of your wine to our inventory and charge you a 30% restocking fee, as well as deduct any outstanding monthly storage fees from your balance. The remaining sum will be turned into a store credit for you that is valid for any purchase up to six months beyond the final notice. If we have heard nothing from you after these six months, your store credit will be canceled. Please note – you will not hear from us after your final notice! To avoid all of this, please take responsibility for your wine or let us know why you are unable to.
Under New York State law, we are only allowed to accept the return of wines and spirits that are defective (within 5 days of purchase with proof of purchase). In such cases, if the same wine is available, you will be offered a replacement. If the wine is no longer available, you will be issued a store credit. Please note: We need the bottle returned with the wine still in it to verify damage!
Any wines that are five years or older are purchased at the Buyer's own risk and are not subject to refund or return in the event that the goods are not in potable condition.
PJ Wine, Inc. will charge a restocking fee of $25 for orders cancelled after delivery or shipping has been attempted.
Prices are subject to change without notice and the Company reserves the right to correct errors in pricing.
Weather & Shipping
We do not ship wine in the hot days of the summer nor the frigid days of winter. We happily offer free storage during these months for all the wine you buy with us. In the event that you must have your wine, we strongly recommend overnight shipping to minimize the chances of temperature damage. If you do choose to ship during the summer or winter, however, you take full responsibility for any and all damage done to the wine because of temperatures. We have two main shipping seasons, a spring season that runs from March until June and a fall season that runs from September until November – naturally the specifics depend on weather patterns and your exact location. When your wine is in stock and your shipping season has come, you will be notified via email. Please note it is your responsibility to plan your shipment for the next available shipping season!
Case discounts are automatically calculated when you check out, where applicable. Please note that wines marked "(Net)" or ending in 7 cents (i.e. $12.47 or $12.97) are not subject to case discounts due to our already exceptionally low pricing.
Press Notes and Scores
PJ's is very happy to cite notes and scores from the press along with our own
write-ups throughout our website to aid you in your purchasing choices. We take
great pride in our efforts to make these citations 100% accurate as far as the
correct attribution, note and score matching up with the correct wine and the
correct vintage. Despite these efforts, on rare occasions, an error may occur.
If you notice an erroneous press citation on our site, please let us know and
we will update it promptly.
Additionally, please note that the presses sometimes revise their notes and scores on specific wines. We make every effort to provide the most recent notes and scores for each wine. However, there may be a delay between when revised notes are published and when they appear on our site. PJ Wine is not responsible for typographical errors.
